New UAE labour rules to kick in on January 1, 2016

Abu Dhabi: The Ministry of Labour has issued three new rules regarding the application of the ministry-approved contracts and conditions for terminating employees and granting workers labour permits to work for new employers.

The new rules, which will come into effect as of January 1, 2016, come within the ministry’s efforts to develop legislation governing and regulating the job market and enhance the relationship between employers and employees on the principles of transparency and satisfaction between both sides.

The new resolutions were revealed by Saqr Ghobash, Minister of Labour.

The minister underlined that the new changes will forge a new stronger relationship between employers and workers and enhance the labour market across the country by encouraging more flexible labour mobility for workers.

Balanced relationship

The three rules, he said, complementone another and establish a framework for a balanced relationship between employers and employees on the grounds of transparency, clarity and the satisfaction of both sides.

Ministerial decisions 764, 765 and 766 will pave the way for improved labour relations by securing more stable labour practices governed by clarified regulations that protect workers who are legally sponsored to enter the UAE.

The new rule will also bring greater transparency, clarity and tighter monitoring of labour contract provisions and ensure both employer and employee enter into fully voluntary relationships, the ministry stated.

Revisions proposed within the three new ministerial decisions will see the creation of a new unified, standard labour contract that will enhance the company-employee contract process as well as encourage more labour mobility by workers who have completed two-year contracts, the ministry said.

The rules will not only revise ministry-approved contracts but also govern rules and conditions for granting a permit for employment by a new employer and outline the rules for terminating employees.

Employers and employees will defer ultimately to the new unified contract with its highly detailed provisions.

What the three concurrent decrees propose to do:

The primary purpose of the decrees is to delink sponsorship and labour relations: the former serves to secure legal entry and temporary residence in the UAE, while the latter is governed by an employment contract the terms of which are compliant with national labour legislation and regulation.

This purpose is achieved by:

Ensuring the transparency of the contracting process in the country of origin;
Ensuring non-substitution of the contract terms post arrival in the UAE;
Defining due processes for terminating labour relations;
